It’s not often that the Supreme Court addresses matters with implications for the MHK industry, but tomorrow, the Court is set to hear Pacific Operators Offshore LLP v. Valladolid, which considers whether the Longshoreman’s compensation provisions of the Outer Continental Shelf Lands Act apply to injuries that occurred off the OCS but related to OCS activities. OREC’s counsel, Carolyn Elefant has posted a lengthy analysis over at her blog, Renewables Offshore . By the way, if you’re tracking offshore safety issues, be aware that on August 1, 2011, the Bureau of Ocean Energy Management announced that it will be conducting a study of safety issues related to renewable energy operations on the OCS. The study is due out in August 2012.
